Box Truck Hits Pedestrian Causing Head Injury

Yesterday, a man was hit by a box truck in a parking lot. According to police reports, he was walking in the parking lot when he was run over by the truck. He was taken by ambulance to Lehigh Valley Hospital-Cedar Crest with a serious head injury.

Work-related transportation accidents cause thousands of serious injuries and over 2000 deaths each year, according to the Bureau of Labor Statistics.  A blow to the head usually causes traumatic brain injury.

“When an employee suffers traumatic brain injury after an accident, it can take months before he or she is able to return to work. In some cases, the employee is not able to return to the job,” said Eric Hageman, a national attorney who represents clients with claims against trucking companies, truck manufacturers and others. “In addition, the employee may be not be able to sue for pain and suffering compensation unless a third party (a company that is not the person’s employer) is legally responsible for the accident.”

When we investigate these kinds of accidents, we are looking for evidence of third-party liability.  Some of the questions we ask are:

  • Who was the driver and who was his or her employer?
  • Who owned the vehicle?
  • Was freight being hauled in the truck and who owned it?
  • Was the truck that hit the pedestrian defective in any way?
