Tibia Fracture from Motorcycle Accident Leads to Infection and Amputation

Update for 2014: Fred and Eric won $5.1 million for another man who was hit by a semi truck while riding his motorcycle. The case was similar to the one below.

In this case, our client was turning left on his motorcycle with 2 other cyclists and a pickup truck behind him. All had slowed down to turn left, their blinkers indicating the turn, when a semi-trailer passed on the left, hitting our client.

Our client sustained critical injuries, including a complex comminuted mid-tibial shaft fracture. He underwent irrigation and debridement of his open tibiofibular fracture with an application of an external fixator. He was in severe pain.

Just 4 days later, his accident wound infected, he returned to the operating room and underwent repeat debridement and irrigation of the muscle, skin, bone, left tibia-fibula and also drainage of the hematoma in the left thigh with placement of a drain and open wound packed.

The next day, he once again returned to the operating room for repeat debridement and irrigation of muscle, bone and subcutaneous tissue of skin, left leg and knee. He continued to fight the infection.

Two days later, he underwent additional irrigation and debridement of his open left tibia fracture with excision of necrotic (dead) skin. During this time, our client had continuous, severe (“unbearable”) leg pain in the area of the fracture and infection. After several more of irrigation and debridement surgeries, doctors amputated his leg below the knee.

Our client described the decision to amputate in his deposition:

“And so we together decided that [amputation] was probably going to be the best move, without having to go through all that other stuff for the partial usage of my leg.”

Fred and Eric presented evidence that the semi-trailer driver was speeding and driving while too tired at the time of the accident. They also uncovered numerous violations of federal regulations by the truck driver and the owner of the semi-tractor, the company that had hired the truck driver.
