An outbreak of Salmonella Bareilly and Salmonella Nchanga has sickened 390 people in 27 states and the District of Columbia, according to a Food and Drug Administration (FDA) memo, and the outbreak may not be over. Forty-seven people have been hospitalized. The outbreak has been linked to scrape tuna imported and distributed by Moon Marine USA. The investigation into the outbreak found unsanitary conditions at the India processing plant where the scrape tuna was made. Moon Marine recalled the scrape tuna, but only after many people had been sickened, and the effectiveness of the recall has been called into question because many people have been sickened after the recall was issued, and the CDC predicts some restaurants have recalled scrape tuna in their freezers and are unaware that it is potentially contaminated with Salmonella bacteria capable of making people extremely ill. We have handled many, many Salmonella food poisoning cases and all of our clients tell us that they were violently ill and in extreme pain.

Many of the victims of this outbreak ate spicy tuna rolls, a kind of sushi roll. Restaurants and grocery stores in 27 states and the District of Columbia sold tuna rolls and similar products made with scrape tuna (a “ground tuna” product) that has been recalled. Some of the restaurants and grocery stores sold the sushi products to victims after the recall, which is at best negligent. And as discussed above, the CDC predicts some restaurants may still have recalled tuna scrape in their freezers. This outbreak may not be over for many months.

There is sufficient epidemiological and microbiological evidence to find Moon Marine USA liable to victims of this outbreak for money damages, including medical expenses, lost income (wages lost because the victim was unable to work), pain and suffering, emotional distress, and all other losses. Attorney Fred Pritzker, lead lawyer for our Salmonella litigation team, represents Salmonella victims throughout the United States. He has won millions for his clients.
