Fred recently won a million dollars in a lawsuit against another cheese producer and another retailer. The facts of that case were almost identical to the facts surrounding this listeriosis outbreak. Fred’s client purchased cheese that a retailer had purchased from the processor. The retailer had then repackaged and rebranded the cheese, which is considered further processing of the cheese. This was important because some state laws protect retailers from food poisoning lawsuits unless the retailer has repackaged the product or provided samples of the product.
Roos Foods has issued three recalls of cheese in the last several days. Our investigation into the outbreak that has resulted in severe illnesses and one death will look at sanitation protocol at the Roos Foods plant, whether it was followed, when Roos Foods was aware that there was a risk of its cheese being contaminated with Listeria monocytogenes, the bacteria that causes listeriosis, why all of the potentially contaminated cheese was not all recalled at once, and other issues.
