Wrongful Death Lawyers Help after a Fatal Semitrailer Rear-End Collision

Attorneys Fred Pritzker and Eric Hageman are representing a family whose loved one, a semitrailer driver, was killed when his rig hit a semi truck that was, we allege, illegally stopped in the road. Below are some of the facts of this wrongful death case.

A Freightliner semi (V1) was stopped in the right lane of westbound I94 when it was struck from behind by an International semi truck (V2) that was also westbound on I94. V2 started on fire after impact. The driver of V1 was taken into custody by the Dunn County Sheriff’s Office for Homicide by Intoxicated Use of a Motor Vehicle.

The driver of V2 died at the scene. According to a medical examiner, it appears that he survived the initial impact of the rear-end collision and died as a result of the intense fire that ignited post-crash.

A crash reconstruction specialist with the Wisconsin State Patrol reported the following after his review of the information and evidence of this case:

  • Based on the statements provided by witnesses, the semi was stopped in the right lane. Some witnesses say that there were running lights on while one stated that he thought it was brake lights. Several witnesses also say there were no triangles or other warning devices out and the stopped unit did not have his flashers on at the time. The physical evidence shows that the collision occurred in the right lane of travel.
  • The driver of V1 and the woman he was allegedly talking to on his cell phone stated that they were talking on the phone with one another at the time of the crash. When looking at the phone records for V1 driver it appears that he was on the phone at the time of the crash.
  • According to a post-crash report, V1 driver had a record of duty status that was false and not current on the date of the accident.
  • The same report also shows that V1 driver was in possession of a Bud Light bottle in the refrigerator of the cab.
  • The same report also states that there was an inoperative brake component, loose brake chamber, specifically axle 2 right with an audible air leak when the brake was applied, axle 2 right.

Fred and Eric are independently investigating this accident for their clients, as they do in every case.
