Applebee’s Lawsuit: E. coli Food Poisoning in MN

Lawsuit Filed against Applebee’s

The E. coli lawsuit filed against Applebee’s (Apple Minnesota, LLC d/b/a Applebee’s Neighborhood Grill and Bar) has been assigned to Judge Paul A. Magnuson, Senior Judge, U.S. District Court, District of Minnesota.  Our attorneys filed the first lawsuit on behalf of Keith Comstock, who was diagnosed with E. coli O111 after eating Oriental Chicken Salad at the Applebee’s in Woodbury, Minn.  They are also representing other people sickened in the outbreak and are preparing to file additional lawsuits.

“For most E. coli outbreaks, it is better for our clients financially to file individual lawsuits,” said Attorney Fred Pritzker. “Class action suits are not appropriate because each client’s injuries are different.”

The lawsuit alleges Mr. Comstock’s salad was contaminated with E. coli O111 bacteria and unfit for human consumption. It seeks compensation for medical expenses, pain and suffering, lost wages and other damages.

We applaud the Minnesota Department of Health for its outstanding work on this outbreak. Finding the source of an outbreak can be elusive, but MDH is relentless and generally finds it.

To date, 9 Applebee’s restaurants are involved in the outbreak: Woodbury, Willmar, Monticello, Bemidji, New Hope, Duluth, Roseville and two locations in Blaine.
