Rocky Ford Cantaloupe Lawsuit: Deadline for Victims to Get Insurance Money for Compensation

Time is running out to file personal injury and wrongful death claims against Jensen Farms and others for illness and death resulting from eating Rocky Ford cantaloupe produced by Jensen Farms of Colorado that were contaminated with Listeria.  The Bankruptcy Court (Jensen Farms filed for bankruptcy) has issued an order regarding the Rocky Ford cantaloupe lawsuit claims that provides for dispersal of insurance money to compensate victims and their families:

  • September 2012 Deadline: All people with claims based on the multistate outbreak of listerosis (Listeria infection) linked to cantaloupe produced by Jensen Farms must complete a court-approved claim form and deliver it on or before September 14, 2012.   • $1,900,000 Bodily Injury Non-Debtors Claims Fund: Insurers for Pepper Equipment Company (sold equipment to Jensen Farms that allegedly caused the Listeria contamination) and Bio Food Safety, Inc. have agreed to tender $1,300,000 and $600,000, respectively, to Jensen Farms for payment of Listeria claims.
