Our lawyers are representing a mother and her newborn baby. The mother ate a packaged caramel apple tainted with Listeria monocytogenes during her pregnancy and the baby was infected with this dangerous bacteria. After birth, the baby became critically ill.
Our young client was sickened in a Listeria outbreak linked to caramel apples purchased at grocery stores and other locations. Other babies were also sickened. To date, Merb’s, Happy Apple and Carnival are the brands associated with the outbreak.

The investigation into the cause of the outbreak points to Bidart Brothers, a California company that supplies apples to other companies. On January 6, 2015, Bidart recalled Granny Smith and Gala apples. The recall was issued after environmental testing by the FDA found Listeria monocytogenes bacteria at the firm’s apple-packing facility. FDA is warning consumers not to eat recalled Granny Smith and Gala apples produced by this company.
