$11 Million for Prolift Mesh Erosion, Time to File a Lawsuit

A jury awarded $11,110,000.00 to a patient who had a Johnson & Johnson (J&J) Gynecare Prolift mesh product inserted through her vagina for pelvic organ prolapse (POP):

  • $7.76 million for punitive damages (an amount meant to punish J&J for wrongdoing);
  • $1.1 million for pain and suffering;
  • $180,000 for lost wages;
  • $500,000 for future lost wages;
  • $385,000 for past medical treatment;
  • $1 million for future medical treatment;
  • and $180,000 for her husband’s loss of companionship and conjugal affections (intercourse caused extreme pain).

The jury found that J&J (via its Ethicon unit) had failed to warn the patient’s surgeon of risks associated with the Prolift mesh product, which J&J pulled from the market in June of 2012, stating that it was not a recall. This woman had constant pain and 18 operations to try to remove the mesh and alleviate the pain after the Prolift mesh was implanted.

“Lawsuits are alleging that these Prolift mesh products that are inserted through the vagina can erode into the vagina, bladder or rectum,” said Attorney Fred Pritzker. Fred and his surgical mesh litigation team have filed lawsuits against manufacturers of surgical mesh on behalf of a number of women.  “The jury in this case found that the patient’s surgeon was not adequately warned of this risk or the difficulty in surgically removing the Prolift mesh.”

This is a bellwether case for the numerous lawsuits filed against J&J for injuries from mesh products. Our law firm is not representing the woman in the bellwether case but is representing a number of women who suffered mesh erosion and needed revision surgery.
