J&J Lawsuit for DePuy Hip Failure

  1. Filing a Claim with Broadspire Did Not Protect Your Legal Rights: In 2010, you and other patients with recalled J&J-DePuy ASR hip implants received a letter from doctors that was drafted by J&J. The letter state that to get reimbursed for certain medical expenses, you had to sign a medical form and send it to Broadspire Services. Filing a claim with this company is not the same thing as filing a DePuy lawsuit in state or federal court. If you have not filed a lawsuit in a court of law, you may lose your right to do so.   2. Revision Surgery and Its Aftermath are “Injuries” for Lawsuit Purposes: Your DePuy ASR should not have failed, requiring you to have hip  revision surgery (your DePuy ASR surgically removed). MDL is a consolidation of pretrial procedures only and is not a J&J hip class action lawsuit.  MDL allows all of the people suing (called plaintiffs) to benefit from a collective effort to gather evidence and try issues of law.

You May Have a Claim for Punitive Damages: Evidence shows that J&J knew its DePuy ASR hip implants caused chromium and cobalt poisoning (metalosis) in 2008, two years before the device was recalled.
