Pritzker Hageman Law Firm Clients Part of $1.4 Billion Settlement

Several of our clients were able to get settlement payouts from the company as part of the $1.4 billion settlement agreed to in December of 2014, with distributions starting in the summer of 2015. The base settlement amounts for these patients was $300,000 per removed failed device.

In July of 2012, Howmedica Osteonics Corp. (“HOC”), doing business as Stryker Orthopaedics, recalled its Rejuvenate and ABG II modular-neck stems. Many patients sued the company, and these lawsuits went into multidistrict litigation (MDL – not a class action, but a consolidation of pretrial procedures).

A settlement on these suits was reached, but 95% of eligible patients had to enroll in the ABG II and Rejuvenate Modular Settlement Program for it to be final. HOC has announced that there has been a 95% enrollment, and that, as a result, the company will move forward with the settlement.

“This is wonderful news for our clients who suffered through traumatic revisions and painful rehabiltiation to know that they will receive fair and timely compensation.  Unfortunately there are still many patients out there who are or will suffer from metallosis from this product and will need to have the Stryker product removed.  Our law firm is still moving forward to help those affected but not covered by this settlement plan.  Patients who have any questions about the product or their rights should call our office at 1-888-377-8900 to discuss their potential claim.” — Attorney David Szerlag

Attorney David will be contacting our law firm’s clients involved in this litigation. They will help each one individually get the compensation agreed to under the settlement.
