When your loved one is killed in an accident, you have wrongful death claims against all parties legally responsible (“liable”) for the accident. This can include the driver of a vehicle, the owner of a vehicle, the owner of a business, the owner of property, a bar that served a drunk driver and others.
Our lawyers dig into corporate documents, interview witnesses and carefully analyze the facts of an accident to determine all liable parties. This is important for two reasons:
- Everyone responsible for the death should be held accountable.
- Some parties have more insurance coverage than others, providing the funds to fully and adequately compensate the family for their loss.
Wrongful death claims involve specific laws that outline the procedures a family must go through to file the claims and recover on them. In most states, a wrongful death trustee (or the equivalent) is appointed by the court. This trustee acts on behalf of the family. Our lawyers work with the trustee and family members to win the case.
In all of our accident death cases, we take the time to get to know who the person who died was, what that person meant to the family (both financially and emotionally), what the person’s job was and what future prospects the person may have had, and what the person’s hobbies and other community activities were. We try to get as full a picture as possible of the person’s life because we have to persuasively present evidence as to the value of that life. The process is difficult for the family, but we understand and try to make it part of the healing process and not an additional burden.
In most states, the wrongful death laws allow next of kin to recover on a wrongful death claim. “Next of kin” as defined in most states includes a spouse, parents, children, grandparents, siblings, nieces, nephews, aunts and uncles.
