Compensation for the Wrongful Death of an Unborn Baby
In Minnesota, a family has the right to sue for money damages when a viable, unborn baby is killed in an accident or due to malpractice, negligence or a defective product.
In 1949, the Minnesota Supreme Court ruled that families of viable (able to live outside the womb), unborn children who die in an accident have the right to sue the person at fault under Minnesota’s wrongful death statute (Minnesota Statutes, section 573.02). The case, Verkennes v. Corniea, 38 N.W.2d 838, Minn. 1949, was the first in the nation to interpret a state wrongful death statute to provide that right.
The issue is one of fundamental fairness. An automobile driver who injures a woman who is eight months pregnant should not have to pay less because the baby died instead of being born with serious injuries.
Under Minnesota wrongful death laws, the family of an unborn baby who died in an accident could recover compensation for the following, depending on the facts of the case:
