Who can file an accident wrongful death lawsuit?

A trustee is appointed to the court upon written petition by the surviving spouse or one of the next of kin. The trustee acts on the family's behalf. Family members who may seek the appointment of a wrongful death trustee include the following:

  • surviving husband or wife
  • children
  • parents
  • grandparents
  • siblings
  • nieces
  • nephews
  • aunts
  • uncles
  • cousins

Any money won in an accident wrongful death lawsuit is shared by the family. Generally, the surviving spouse and the children get most of the money. If a child has died, the parents get most of the money.

Accident Wrongful Death Compensation

An important goal of an accident wrongful death lawsuit is to make sure that the family does not unecessarily suffer financially. Each state has different laws about the type of losses for which wrongful death compensation is allowed.

  • All states allow for the recovery of lost income the decedent would have provided his loved ones.
  • Most states do not allow recovery for grief or anger suffered by the surviving heirs, but do allow money damages for the loss of advice, care, comfort and companionship the deceased would have provided had he or she lived.
  • Some states also allow money damages for the pain and suffering of the deceased person prior to death.

For example, one of our families set up a scholarship after their child died that provides money for students who are pursuing the degree their son had dreamed of pursuing before he was killed by an 18-wheeler.

$2,469,339 Verdict For Family
