Trailer Accident Investigation: Building a Winning Case
When our lawyers investigate a trailer accident, they gather and preserve evidence, analyze the evidence, and build a winning case. Trailer parts can include a hitch receiver, draw bar, ball mount, trailer tongue, T connector, sway control, bearing, and coupler. The parts involved depend on the vehicle and the trailer. Every part must be gone over carefully to determine if the parts were defective in design, in manufacturing or in maintenance.
Trailer accidents can be caused by the following:
- A trailer hitch was not fitted properly on the ball
- The locking mechanism was not in place or did not work
- Safety chains were not used or were not in working order
- The load carried by the trailer was in the rear, causing the tongue to come loose and the trailer to detach
- The trailer hitch, locking mechanism or safety chains had a flawed design that resulted in a trailer detaching from the hauling vehicle (click for trailer recall information)
The kind of vehicle towing the trailer (for example, a semi tractor), the contents of the trailer, the trailer parts involved and other factors will determine what parties are liable (legally responsible) for the accident. Possible liable parties include the following:
- The driver of the vehicle pulling the trailer
- The owner of the vehicle pulling the trailer
- The owner of the trailer
- The owner of the freight being hauled in the trailer
- The employer of the driver
- A manufacturer
- A maintenance company
To build a winning case, witnesses must be interviewed, the victim (if alive) and his or her family must be interviewed, corporate documents must be recovered and analyzed, details of ownership and corporate relationships must be uncovered, expert witnesses must be hired. It is expensive, and our law firm has the resources to do the job right. We are not paid unless you win.
