Toyota Class Action Lawsuit: Class of Plaintiffs Defined
Our law firm is available to represent businesses that purchased Toyota vehicles for resale that were subsequently recalled. For purposes of the Toyota class action lawsuit, the class of plaintiffs (parties who can be part of the lawsuit) is defined as follows:
All retail and wholesale automotive sales entities that own and/or have purchased for resale Toyota vehicles subject to a Toyota recall issued due to a problem with sudden and unexpected acceleration, including any of the following: 2007-2010 Camry, 2005-2010 Avalon, 2004-2009 Prius, 2005-2010 Tacoma, 2007-2010 Tundra, 2007-2010 ES 350, 2006-2010 IS 250 and IS350, 2008-2010 Highlander, 2009-2010 Corolla, 2009-2010 Venza, 2009-2010 Matrix, 2009-2010 Pontiac Vibe, 2008-2010 Sequoia, 2009-2010 RAV4.
As additional information regarding sudden, unintended acceleration of these (and perhaps other) vehicles surfaces, the above definition of plaintiffs may be altered to include others. Toyota Class Action Lawsuit: Compensatory Damages
Compensatory damages are meant to make the plaintiffs whole economically. The economic losses associated with owning a recalled Toyota vehicle for resale or lease are substantial:
- The fair market value of the recalled Toyota vehicles has dropped and may drop further.
- There is a daily cost for holding pre-owned Toyota vehicles on a used car lot.
- Used cars lose value while sitting on a used car lot for an extended period of time.
- Money is lost when a vehicle that is hard to sell is purchased instead of one that would have been easier to sell.
- Money may have borrowed to purchase the used Toyota for resale, meaning accrued interest is associated with the recalled Toyota that sits on the lot and can't be sold.
- Toyota put a Stop Sales Order on certain recalled Toyota vehicles, making it impossible, for a time, to sell the vehicles.
- Because of Toyota's inept, possibly fraudulent behavior in regard to the accelerator problems that led to the recalls, the recalled Toyota vehicles now have a stigma associated with them.
Toyota Class Action Lawsuit: Punitive Damages
Punitive damages are meant to punish behavior as a deterrent to future, similar behavior. Punitive damages are awarded where compensatory damages are deemed an inadequate remedy due to malicious or reckless behavior.
The Toyota recalls of millions of vehicles due to accelerator problems came years after the first reports of sudden, unexplained acceleration of vehicles, even then Toyota blamed floor mats and released a statement on Nov. 3, 2010, stating The National Highway Traffic Safety Administration (NHTSA) had concluded that "no defect exists" in the recalled vehicles. NHTSA responded by calling Toyota's "inaccurate and misleading."
Later meetings between Toyota and NHTSA officials revealed additional information that we allege indicates a pattern of fraud and concealment on the part of Toyota.
On February 16, 2010, NHTSA announced that it is using its statutory authority to obtain documents from Toyota to determine if the automaker conducted three of its recent recalls in a timely manner. Federal law requires all auto manufacturers to notify NHTSA within five days of determining that a safety defect exists and promptly conduct a recall.
NHTSA officials are checking whether Toyota has covered all affected models in its recent recalls to ensure Toyota did not miss any problems. The agency will obtain information on production data, incidents, complaints, warranty complaints, copies of tests, dates of meetings, timelines, and supplier information.
The information gathered in the NHTSA investigation will be used in Toyota class action lawsuits to prove that members of the class should be awarded punitive damages because Toyota acted with malice and in a reckless manner, causing both physical and financial harm.
