Lexus Class Action Lawsuit: Car Dealers Included in Class

All retail and wholesale automotive sales entities that own and/or have purchased for resale Lexus 2007-2010 ES 350, 2006-2010 IS 250 and 2006-2010 IS350 vehicles which were subject to a recall issued by Toyota due to a problem with sudden and unintended acceleration. Lexus Class Action Lawsuit: Compensatory Damages
Compensatory damages are meant to make the plaintiffs whole economically. The economic losses associated with owning a recalled Lexus vehicle for resale or lease are substantial:
- The fair market value of the recalled Lexus vehicles has dropped and may drop further.
- There is a daily cost for holding pre-owned Lexus vehicles on a used car lot, including interest on any loan used to buy the vehicle and the value of the space used to store the vehicle.
- Used cars lose value while sitting on a used car lot for an extended period of time.
Lexus Class Action Lawsuit: Punitive Damages
Punitive damages are meant to punish behavior as a deterrent to future, similar behavior. Punitive damages are awarded where compensatory damages are deemed an inadequate remedy due to malicious or reckless behavior.
The recalls by Toyota of millions of vehicles due to accelerator problems came years after the first reports of sudden, unexplained acceleration of vehicles, even then Toyota blamed floor mats and released a statement on Nov. 3, 2010, stating The National Highway Traffic Safety Administration (NHTSA) had concluded that "no defect exists" in the recalled vehicles. NHTSA responded by calling Toyota's "inaccurate and misleading."
Later meetings between Toyota and NHTSA officials revealed additional information that we allege indicates a pattern of fraud and concealment on the part of Toyota.
