Semi-Truck Crash Settlement

truck-car accident case.

- $2,750,000 car accident settlement in a truck personal injury case. Our client's head was crushed, causing traumatic brain injury (TBI), the loss of his left eye and significant disfigurement.

The truck’s insurer refused to make any settlement offer contending the bicyclist was at fault. The jury returned its verdict in favor of the bicyclist’s survivors following an eight day trial.
- $2,000,000 for the family of a 37 year-old male who was killed when his vehicle was struck from the rear at high speed by a garbage truck.
- $1,700,000 for a 42 year-old man who was run over by a semi-tractor as the man stood beside the road while assisting another motorist who crashed in an earlier accident. The victim sustained a number of fractures and internal injuries from which he never fully recovered.
- $1,536,921 for a 36 year-old man who was run over by a garbage truck.
- $1,225,666 for a 50 year-old female who suffered a severe traumatic brain injury when the vehicle she was operating was struck by a farm sprayer that failed to stop at a rural intersection.
Video: $2,560,000 Semi Truck Settlement
Pritzker Olsen attorneys Fred Pritzker and Eric Hageman recently obtained a hard fought $2,560,000 recovery for the victims of a semi-truck crash. This case is discussed in the video below.
The clients, a husband and wife in their sixties, were returning from a family reunion when their automobile was hit from behind by a semi-truck. The initial impact caused their vehicle to lose control, cross the center median and collide head-on with an SUV traveling in the opposite direction.
The husband suffered a traumatic brain injury and both the husband and wife had extensive orthopedic injuries.
The cause of the crash was hotly contested. The trucking company claimed the driver of the car allowed her vehicle to drift into the truck’s lane while the plaintiffs contended the truck drifted into their lane. Eyewitness testimony supported each claim.
Pritzker and Hageman retained the services of an accident reconstruction and photogrammetric expert able to identify and map out tire markings from the automobile that showed it was in its proper lane at the time of the initial impact. Using that data, the lawyers retained the services of an animationist to create a short video demonstrating how the crash occurred.
Not to be outdone, the trucking company hired its own reconstruction expert and an engineer who prepared a computer simulation of the crash using a software program claimed to be more scientifically accurate than the plaintiffs’ animation.
Pritzker and Hageman attacked the scientific claims of the defendant’s engineer by retaining an expert in the same software program in order to prove the software program was manipulated to reach a pre-ordained conclusion. They also brought a motion to exclude the testimony of the trucking company experts and the simulation on which it was based. The case settled the day prior to the hearing on the plaintiffs’ motion to exclude (which was only three days prior to trial).
In addition to the scientific and technical evidence, Pritzker and Hageman discovered documents showing that the driver of the truck had only 4-5 hours of sleep the night prior to the crash and then altered his log book to make it appear he had slept longer.
