Drunk Truck Driver:
Rear End Collisions
Under the law, the driver of a semi trailer or other commercial truck must exercise extreme care to avoid a rear end collision. Additionally, under the Federal Motor Carrier Safety Regulations (FMCSR), “no driver shall report for duty or remain on duty requiring the performance of safety-sensitive functions while having an alcohol concentration of 0.04 or greater.” (49 CFR Part §382.201) In most rear end accidents, we look for evidence of speeding, distraction or tailgating.
When a vehicle has been rear ended by a drunk truck driver, it is irrelevant whether the driver was speeding or tailgating.
- The truck driver would be considered negligent under the law for driving drunk and causing a rear end accident.
- Commercial truck drivers are not allowed to consume alcohol while driving (382.205).
- Commerial truck drivers are not even allowed to consume alcohol within the four hours prior to driving (382.207).
