Synthes Ti Synex II VBR Recall
After reports of six adverse events, Synthes USA recalled Ti Synex II Vertebral Body Replacement (VBR) products on September 14, 2009.
The six adverse event reports included moderate to severe loss of vertebral body replacement height (caused by failure of the central body component) at six to fifteen months post implantation. Loss of device height may result in nerve injury, increased pain, spinal compression fracture, failure of additional fixation, and/or need for a reoperation or an operation to modify the implanted device.

Legal Consequences of the Synthes Synex Recall
The Synthes Synex recall was prompted by the six adverse events discussed above. In each of these cases, the patient suffered injury when the Ti Synex VBR lost height.
After reviewing the facts of these cases, on November 12, 2009, the FDA announced that it had classified the recall of Synthes Ti Synex II VBR products as Class I. This means that these products could pose an imminent hazard to health in patients.
The FDA findings that led to the Class I recall may be used as evidence in a Synthes Synex lawsuit.
