OsmoPrep Lawsuit: Proving Your Case

One of the elements of a OsmoPrep lawsuit is causation. The FDA has found a connection between kidney injury and the use of OsmoPrep, manufactured by Salix Pharmaceuticals.

On December 11, 2008, FDA issued a safety alert regarding OsmoPrep. The safety alert was prompted by twenty unique cases of acute kidney injury associated with the use of OsmoPrep reported to FDA’s Adverse Event Reporting System (AERS) database. Five cases were reported to be life-threatening and ten resulted in hospitalization. Of these 20 cases, 4 patients required dialysis for an unspecified period of time and one patient died from complications of pneumonia.

Under its new authorities provided in the Food and Drug Administration Amendments Act of 2007, FDA required Salix Pharmaceuticals to add a Boxed Warning to the labeling for OsmoPrep. The boxed warning was added in May of 2009 and reads as follows:

There have been rare, but serious reports of acute phosphate nephropathy in patients who received oral sodium phosphate products for colon cleansing prior to colonoscopy. Some cases have resulted in permanent impairment of renal function and some patients required long-term dialysis.

Acute phosphate nephropathy is a form of acute kidney injury that is associated with deposits of calcium-phosphate crystals in the renal tubules that may result in permanent renal function impairment.
