ETHEX and KV Phamaceutical Lawsuit and Strict Liability

Medication errors can happen when a pharmaceutical company manufactures tablets that are the wrong dose of the medication. When this happens and someone dies or is injured, the pharmaceutical company may be strictly liable for that death or injury. Suspension of KV Pharmaceutical Tablets: Benazepril, Buspirone, Dextrophetamine, Doxazosin, Isosorbide, Metoprolol, Morphine Sulfate, Ondansetron, Oxycodone, Potassium Chloride, Propafenone

KV Pharmaceutical has advised the U.S. Food and Drug Administration that, effective midnight Dec. 19, 2008, the company voluntarily suspended shipments of all FDA-approved drug products in tablet form.  This all-inclusive suspension of distribution of prescription tablets was due to manufacturing issues “that have come to management’s attention” at KV Pharmaceutical.
The following ETHEX Corporation/KV Pharmaceutical tablets are affected:

  • Benazepril HCl Tablets
  • Buspirone HCl Tablets
  • Dextroaphetamine Sulfate Tablets CII
  • Doxazosin Mesylate Tablets
  • Hydromorphone HCl Immediate Release Tablets, CII
  • Isosorbide Mononitrate Extended-Release Tablets
  • Metoprolol Succinate Extended Release Tablets, USP
  • Morphine Sulfate Extended Release Tablets, CII
  • Ondansetron Orally Disintegrating Tablets
  • Oxycodone HCl Tablets, CII
  • Potassium Chloride 20 mEq Extended-Release Tablets
  • Propafenone HCl Tablets

KV Pharmaceutical is also recalling a single production lot of Hydromorphone HCl 2 mg tablets (Lot 90219, Exp: 3/2010; NDC 58177-0620-04), a pain management drug, following the report of an oversized tablet. Read about the hydromorphone recall.
