Personal Injury and Wrongful Death
FAQIf I have a semi truck accident insurance claim,
how do I protect my rights?
If your car, motorcycle, bicycle or van is hit by a semi truck, the trucking company's insurance company will be involved. Commercial trucks governed by the U.S. Department of Transportation must carry liability insurance for accidents that result in bodily injury or wrongful death. States require minimum liability coverage for commercial vehicles not regulated by the U.S. Department of Transportation.
You will be contacted by at least one commercial truck insurance adjuster. DO NOT TALK TO THEM. Their job is to get information from you that will result in less compensation for you. If you are contacted, tell them you are hiring an attorney and contact our accident attorneys for a free consultation.
If you have retained a truck accident lawyer, give the insurance company representative the phone number of the law firm and no other information. Again, politely hang up. Most people do not realize that even a friendly conversation with an insurance representative can be used against them. For example, most insurance representatives will express concern and ask how you are and/or how your child is, if the child was involved in the accident. Do not answer them. If you have retained us, give them our phone number (1-888-377-8900) and say nothing else. Remember that insurance representatives are trained to get information from you that the insurance company can use in its favor.
Your insurance company is also involved. You need to report the accident to your insurance company. When you do, do not tell them how you feel or provide any information other then what is in the accident report. If your insurance company asks you a question that makes you uncomfortable, contact our law firm immediately (toll free 1-888-377-8900). Do not sign anything without contacting our truck accident lawyers first.
Other insusrance companies may also be involved. For example, if the semi truck driver was at fault, the owner of the freight he or she was hauling may also be liable. For more information about liability, please see “Truck Accident Lawsuit: Liability.”
If an insurer refuses to pay a claim, and you think the insurance company was supposed to pay, contact our law firm regarding insurance bad faith. We have successfully won cases against insurance companies that have tried to avoid paying on a claim.
