Tractor-trailer accidents can involve complex liability issues. In some accidents the tractor (truck cab) is owned by one company, the trailer is owned by another company, yet another company owns the freight being transported, and the truck driver is not an employee of any of the companies. In these cases, the person injured or the family of the person killed needs to be fully compensated, but every company will claim they are not repsonsible.
In the following tractor-trailer accident case, an appellate court denied one company's claim that it was not liable:
A woman was rear-ended by a tractor-trailer. The tractor was owned by Penske and the trailer was allegedly owned by Gly-Tech Services, Inc. Penske claimed it was not liable for the injuries because the driver was not employed by Penske. The appellate court disagreed because the tractor portion of the tractor-trailer could have been experiencing mechanical difficulties that caused the accident. Specifically, there was a question as to whether the braking system of the Penske was in good working order on the date of the accident (Jones v. Penske Truck Leasing Corporation, et. al).1
