Personal Injury and Wrongful Death

Semi Truck Accident: Work Injury Case Study

Injuries and wrongful death related to a workplace injury can involve both workers’ compensation and civil damages under traditional tort law.  An example of this is a case involving the death of an employee who was crushed between two commercial vehicles, one owned by his employer and one owned by a third party corporation.

In this hypothetical case study, a delivery company employee is operating a tractor-trailer owned by the delivery company when he backs it against a stationary trailer owned by another company ("Company 2"). While doing this, the delivery company employee crushes an employee of Company 2 between the two trailers.  The employee of Company 2 dies.

The defendants (people being sued) in the wrongful death lawsuit that would be filed by the deceased employee's family would include: the delivery company driver/employee, the delivery company, Company 2 and others.

Company 2 would be part of a workers’ compensation claim seeking reimbursement of the deceased employee's medical expenses.  Claims against the delivery company and the delivery company driver/employee would involve traditional wrongful death claims seeking compensation for compensatory damages above and beyond what could be collected through workers’ compensation.

It is important for a good truck accident lawyer to sort out the facts and determine the parties that may be responsible for injury or death in a truck accident case.

In the hands of a good lawyer, workers injured in employment-related accidents and families who have lost loved ones in employment-related accidents can often recover amounts substantially above the amounts that could be recovered under workers’ compensation alone.
