Personal Injury and Wrongful Death

Lawsuit Against Trucking Firm

Accident Personal Injury Attorney MNYour truck accident lawyer must sort out who the liable parties are in your semi truck accident case. The more parties responsible, the more insurance policies to access to recover compensation to fully and fairly compensate the victims of the accident and their families.

Liable parties in a semi truck accident lawsuit may include the following:

  • The owner of the semi truck  When there is an accident involving a commercial truck, the owner of that truck is jointly liable with the driver of the truck.
  • The driver of the truck.  The driver of the truck is generally jointly liable with the owner of the truck, but the driver usually has very limited assets.
  • The employer of the driver (the trucking firm).  Employers are vicariously liable for any accidents caused by its employees while they are acting within the course and scope of their employment.  If the owner of the truck is also the employer of the driver, the owner is also liable both as the owner and as the employer.  If the employer is not the owner of the truck, there is one more pocket to dip into.
  • The employer of the owner of the truck or employer of the driver.  For example, if the employer of the driver is employed by another party and the driver was acting within the scope of that employment relationship.
  • The manufacturer of truck parts.  If a defective truck part (e.g. brakes) caused the semi accident, the manufacturing firm may be named in the lawsuit.
  • The manufacturer of the truck.  If it is determined that a defective design lead to the truck accident, the manufacturer of the truck may be liable.
  • A third part maintenance company. If the semi truck maintenance was inadequate and performed by another firm, that firm may be liable.
