18-Wheeler Accident Information: Federal Regulations

The Federal Motor Carrier Safety Administration (FMCSA) regulates 18-wheelers involved in interstate commerce. Below are a few of the areas regulated by FMCSA:

    1. The amount of time a driver can drive.  The amount of driving and off-duty time is required to be recorded in the driver’s log.  One of the first things our law firm does in an 18-wheeler case is to take legal steps to obtain a copy of the driver's log. Because there have been cases where the drivers log was altered or destroyed, it is important to move fast.
    2. Truck driver drug and alcohol use. FMCSA regulations require motor carriers to implement a successful controlled-substances-use-and-alcohol-misuse program. Trucking companies also need to do background checks on truck drivers. If a trucking company fails to perform required background checks and drug tests, an accident involving a drunk truck driver may lead to a claim against the trucking company for negligence.
    3. Truck maintenance and parts and accessories.  FMCSA has detailed requirements regarding parts and accessories necessary for safe operation.  If our law firm is retained by you, we will look at whether the accident was caused, even in part, by improperly maintained equipment, the lack of safety equipment or any other equipment-related question, which would include problems with tires, lights, axles, coupling devices and towing equipment, brakes, engines and other equipment.
