Toyota Recall: Floor Mat and Stuck Accelerator Issues
Lexus and Toyota recalled over 4 million vehicles because the removable floor mats could cause the accelerator ot get stuck open under certain circumstances. What if I Was Hit by a Drunk Truck Driver?
Even if the truck driver was not “drunk” under state law, the driver may have violated federal regulations governing interstate, commercial truck drivers.  Under these regulations, “no driver shall report for duty or remain on duty requiring the performance of safety-sensitive functions while having an alcohol concentration of 0.04 or greater” (49 CFR Part §382.201).  Violation of this regulation is evidence of driver negligence in a lawsuit seeking accident victim compensation. "Seat Belt Gag Rule"
The Minnesota Supreme Court has broadened the interpretation of the exception to the "seat belt gag rule" to include incidents that involve a parent’s “negligent installation and maintenance” of their child’s car seat.  In the case before the court, a child sued his parents after the child was injured in a car accident in which his mother was driving.  His father had negligently secured him in the car seat.  Because the exception to the "seat belt gag rule" applied, the child was able to obtain compensation for the resulting injuries from his parents' auto insurance company.  Read more about a child car seat lawsuit.
