Intersection Collision and Right-of-Way
When there is an intersection collision, several factors need to be considered to determine who is at fault for the accident. One factor is right-of-way. In Minnesota, as in most states, “right-of-way” is established by statute. The primary Minnesota right-of-way law is Minnesota Statutes Section 169.20.
Even though a driver may have had right-of-way, if the driver was speeding, the driver thereby forfeited right-of-way. This may be the case even if the driver was driving within the speed limit but at an unreasonable speed considering the circumstances.
