Drew, Chad and Scott were life-long buddies. They went to the same school and the same church. On February 10, 1999, the three teenagers were going to church for a band rehearsal when Chad's Geo Metro skidded off the road and hit a tree.
The impact was devastating. In the front seat, Chad and Drew were unconscious and trapped in the wreckage. Scott crawled out a rear window to get help. Emergency personnel cut off the top of the car to free the young men. Sadly, Chad died shortly thereafter while Drew was hospitalized with a serious brain injury.
Drew subsequently underwent brain injury rehabilitation to relearn basic skills. With hard work and much dedication, Drew was able to return to school and resume his life. Though he still has trouble with his memory and concentration and bears the emotional scars of the experience, he survived and is moving on.
Drew's hospitalization quickly exhausted his family's $20,000 no-fault medical limit. Deb and Carl, his parents, were overwhelmed. After an unpleasant call from the insurance company, they knew they needed legal assistance.
Car Accident Brain Injury Settlement: The Compensation
As an airplane mechanic, Carl's union lawyer referred him to brain injury specialist Fred Pritzker for a free consultation. "The burden was taken off my back when I turned the case over to Fred. Pritzker outlined a course of action that included an evaluation by a neuropsychologist, which proved critical, since testing confirmed that Drew had residual effects from his brain injury. Armed with the test results and other documentation and reports, Pritzker made a demand on the liability carrier for the policy limits. At first, the carrier refused to tender the limits but eventually did so if Drew and his parents were willing to accept the proceeds in a structured settlement (a form of annuity that features significant tax benefits) placed through the carrier's annuity company.
Pritzker determined that by placing the structured settlement through the liability carrier's company, Drew would receive significantly less in return than if purchased in the open market. He also determined that the liability carrier misrepresented the actual cost of the annuity. Pritzker exposed this and threatened sanctions, forcing the carrier to agree to place the settlement in any company selected by Drew and his family.
Drew plans on enrolling in college in the fall. Although he has come a long way since the night of his accident, he continues to have problems. He always hoped to attend the University of Minnesota but due to his memory and concentration difficulties, he may start with community college and then transfer if he keeps his grades up.
