Airbag Failure to Deploy
In 1998, Federal Motor Safety Standard 208 (FMVSS 208) was amended to require dual front airbags in all passenger cars and light trucks.
If airbags are functioning, when there is a moderate to severe crash, a signal is sent from the air bag system's electronic control unit to the inflator within the air bag module. An igniter in the inflator starts a chemical reaction that produces a harmless gas, which inflates the air bag within the blink of an eye - or less than 1/20th of a second.
When an airbag fails to deploy and inflate during a moderate to severe crash, injuries to the driver and front-seat passenger can be far more severe. A lawsuit against the manufacturer of the air bag, the car and others may be possible. Claims can be made based on strict liability law, negligence and contract law. Airbag Injury During Crash
When the force of an airbag injures or kills a driver or passenger, there may be grounds for an airbag failure lawsuit. For example if an airbag is defective in manufacture or design and is deployed with more force than it should be, there would be a claim under strict liability laws.
