Penske Truck Accident and Lawsuit Information

In the two years prior to December 4, 2008, Penske Truck Leasing (Penske) was involved in 1,196 accidents with 480 resulting in injury and 20 resulting in fatalities, according to the Federal Motor Carrier Safety Administration (FMCSA).¹

Examples of Penske truck accidents include the following:

• In a Louisiana case, a woman was rear-ended by a tractor-trailer.  The tractor was owned by Penske and the trailer was allegedly owned by Gly-Tech Services, Inc.  Penske claimed it was not liable for the injuries because the driver was not employed by Penske.  The appellate court disagreed because the tractor portion of the tractor-trailer could have been experiencing mechanical difficulties that caused the accident.  Specifically, there was a question as to whether the braking system of the Penske was in good working order on the date of the accident (Jones v. Penske Truck Leasing Corporation, et. al).²
• According to the South Carolina Highway Patrol, a tow-truck driver was putting a disabled vehicle onto a wrecker when a passing Penske truck, a moving-van-type box truck, hit him.  The tow-truck driver was airlifted to a hospital, where he died from his injuries.  The driver of the Penske truck was cited for speeding (driving too fast for the conditions).³
• In Virginia, a man died after a Penske delivery truck backed over him.  The Penske truck had a device that was supposed to make a beeping noise when the truck backed up, but according to authorities, the device was working properly at the time of the accident. Penske has been accused of negligent failure to inspect and maintain the vehicle.⁴
