Personal Injury and Wrongful Death

Prescription Overdose Wrongful Death Lawsuit

Generally, a prescription medication overdose is determined during an autopsy. When a finding of prescription overdose is made, the autopsy report does not whether the wrong dose was prescribed or given to the patient by a pharmacy. When our law firm is retained by a family in an overdose case, we obtain all pertenant medical records, interview medical personel and take other measures to determine the cause of the overdose.

If medical negligence caused the overdose death, the family can sue for compensation in a wrongful death action. Generally, wrongful death compensation includes the following:

  • Funeral expenses
  • Medical expenses related to the overdose
  • Lost income (including an estimate of the future income of the person who died of the propoxyphene overdose)
  • Loss of care and companionship
  • Pain and suffering (not available in some states)
