In December 2008, the FDA alerted health professionals to the potential risk of kidney failure associated with use of OsmoPrep, a colon-cleansing pill used prior to a colonoscopy.

In the alert, the FDA stated that certain people are at greater risk of developing kidney failure with the use of OsmoPrep, including the following:

  • People over aged 55
  • People who have kidney disease, bowel obstruction, active colitis, or are dehydrated
  • People taking drugs that affect renal perfusion or function such as diuretics, ACE inhibitors, angiotensin receptor blockers (ARBs) and possibly NSAIDS

What does this mean legally?
It means that OsmoPrep kidney failure victims in a high risk group may have a medical malpractice claim against their doctors for negligently prescribing OsmoPrep.

The FDA alert also stated the following:

Prescribers should instruct patients about how to prepare for their procedures, and tell them to avoid dehydration by drinking enough clear liquids before, during and after bowel preparation. They should also tell patients to be alert for symptoms of acute kidney injury, including malaise, lethargy, drowsiness, decreased urine volume and swelling of the ankles, feet and legs.

What does this mean legally?
It means that doctors who do not instruct patients as described above may be negligent and liable to any OsmoPrep kidney failure victims.
