Salmonella Cases Associated with the Flying Tortilla - Lawsuit and Lawyer

According to New Mexico health officials, 4 people have been sickened in a Salmonella outbreak associated with the Flying Tortilla, a Santa Fe, New Mexico restaurant.  The four people ate at the Flying Tortilla in Santa Fe from mid-January to mid-February, 2008.  Three of the illnesses were diagnosed in January.

Restaurants are generally strictly liable for illnesses caused by the food they prepare.  Strict liability means the party is liable even if the party is not at “fault” (acted without negligence or intent to do harm).  People who are sickened by restaurant food can seek compensation from the restaurant for medical expenses, lost earnings, pain and suffering and other damages.  We have recently settled a Salmonella case involving a restaurant.  In that case, the food source was never pinpointed.  If you have a question about restaurant liability, please contact us toll-free at 1-888-377-8900, email Fred Pritzker, or submit the firm’s free case consultation form.
