MDPH Investigation Continues in Boston – Listeria Lawyer and Whittier Farms Lawsuit Information
Four people—three elderly men and an unborn baby—have died in a Listeria (listeriosis) outbreak linked to Whittier Farms milk, according to the Massachusetts Department of Public Health (MDPH) in Boston. The Investigation in Boston and Listeria – Lawyers and Liability
When a state health department (MDPH in Boston in this case) is made aware of cases of Listeria infection (listeriosis), genetic fingerprinting tests can be done to identify the specific strain of Listeria monocytogenes that caused the illness. Matching strains of Listeria monocytogenes indicates that the cases were caused by a common source. If a common food source is identified by epidemiological and/or microbiological evidence, processors, distributors, retailers and/or restaurants may be “liable” (responsible) for damages sustained by the people sickened and their families. If someone dies, that person’s next of kin can make a wrongful death claim against responsible parties.
In this case, according to a MDPH press release out of Boston, genetic fingerprinting has established a link between the people sickened and Whittier Farms milk:
DNA fingerprinting conducted by the State Laboratory Institute showed that the bacteria causing these infections came from a common source. Whittier Farms milk product samples collected from a patient’s home and from Whittier Farms showed listeria contamination. The DNA fingerprints of the listeria found in the milk samples and in the patients were the same.
