University of Colorado (UC) E. coli: Lawsuit Information

An E. coli O157:H7 outbreak at the University of Colorado at Boulder (CU) that began in September 2008 has grown to include 6 other people, 3 from Boulder and 3 from elsewhere in Boulder County. Several of the victims are CU students and one is a sorority adviser. Most of the affected students are members of the same sorority. 

Health officials have associated the illnesses with Jimmy John's sub.

In E. coli litigation cases involving a contaminated food product, strict liability usually applies. This means that E. coli victims only need to prove the following: 1) that the food was contaminated with E. coli and 2) that the contaminated food caused the injuries, the E. coli infection and any illnesses related thereto, for example, hemolytic uremic syndrome (HUS), a leading cause of kidney failure. It is not necessary to prove that anyone intentionally or negligently contaminated the food.
