for the Survivor of an Ohio E. coli Outbreak

The following is an excerpt from the complaint (the document filed with the court that sets out the reasons for the lawsuit) filed by our law firm in the case of Zachary D. Everhart v. Kroger Co. and Nebraska Beef, Ltd.  The case was brought before the Ohio state court and involved injuries suffered by Mr. Zachary caused by consumption of Kroger ground beef, the components of which were supplied by Nebraska Beef, Ltd.

The following excerpt from the complaint sets out the injuries Mr. Zachary suffered:

17.       On or about June 11, 2008, Plaintiff Everhart developed symptoms of E. coli O157:H7 infection including severe bloody diarrhea and abdominal cramps.  After passing copious quantities of blood in his stool, Plaintiff Everhart was taken to an urgent care facility and then to Mount Carmel Hospital in Columbus, Ohio.  Plaintiff Everhart continues to suffer from symptoms and complaints as a direct result of his E. coli infection.

18.       Testing confirmed that Plaintiff Everhart contracted E. coli O157:H7 with a PFGE pattern indistinguishable from those found in beef produced by defendant Nebraska Beef.

19.       The Ohio Departments of Agriculture and Health concluded that E. coli O157:H7 caused the illness of the Plaintiff Everhart and confirmed that his illness was part of the E. coli outbreak associated with the ground  beef recalled by the defendants and each of them.

The lawsuit sought compensation for Mr. Everhart's time off of work, medical expenses, physical pain and emotional anguish.
