University of Michigan and MSU E. coli Lawsuit Information

At least 9 Michigan State University (MSU) students have confirmed E. coli O157:H7 infections.  The outbreak has grown to include38 people in Michigan, 9 people in Illinois and 3 people in Ontario, Canada. 21 people have been hospitalized.

There is strong epidemiological evidence that the source of the outbreak is bagged, industrial-sized packages of iceberg lettuce distributed by Aunt Mid's Produce Company. Read about an Aunt Mid's lawsuit.

Some of the 38 Michigan cases consumed shredded or chopped iceberg lettuce in restaurants or institutions, which had purchased the lettuce from Aunt Mid’s Produce Company, a Detroit-based wholesale distributor. The heads of lettuce being supplied to Aunt Mid’s for washing, cutting, and bagging during the outbreak timeframe were identified as lettuce from California. However, the point at which the lettuce was contaminated is still unknown.

Distributor and Food Service Facility Liability

If you are a victim of the University of Michigan and Michigan State University E. coli outbreak associated with iceberg lettuce, the following parties may be liable for the damages you suffered, including medical expenses, pain and suffering and loss of income:

  • The university
  • A food service company
  • One or more food distributors (Aunt Mid's and/or another food distributor)
  • A food processor
  • The owner of the field where the lettuce was grown

In E. coli litigation cases, strict liability usually applies. This means that E. coli victims only need to prove the following: 1) that the food was contaminated with E. coli and 2) that the contaminated food caused the injuries, the E. coli infection and any illnesses related thereto, for example, hemolytic uremic syndrome (HUS), a leading cause of kidney failure. It is not necessary to prove that anyone intentionally or negligently contaminated the food.
