Colorado E. coli: Lawsuit Information

On September 23, 2008, Boulder County Public Health (BCPH) began investigating an E. coli O157:H7 outbreak at the University of Colorado at Boulder (CU). Initially, 8 people (7 students and one sorority adviser at the Univeristy of Colorado at Boulder) were identified as part of the outbreak. Health officials associated those illnesses with consumption of sandwiches from Jimmy John's.  

The Colorado Health Department is now investigating 3 additional E. coli cases that have surfaced in Boulder and 3 E. coli cases elsewhere in Boulder County.

Because all 14 people were sickened by E. coli with matching genetic fingerprints, all of the illnesses have a common source. Since epidemiological evidence has associated some of the illnesses with Jimmy John's subs, the common source of the outbreak must be a food product used in the Jimmy John's subs, for example, lettuce.

Restaurant Liability

Generally, restaurants are liable for illnesses caused by the restaurant's food even if health officials are not able to pinpoint the specific food product that caused the illnesses.
