Child Safety Recalls

Pritzker | Ruohonen & Associates, P.A., a nationally-known personal injury law firm, represents people injured by products subject to child-safety recalls.  Each year hundreds of children are injured by defective toys and other products marketed to children.  Injuries can include lead poisoning, burns, and lacerations. 

To date, manufacturers, distributors and sellers of toys and other products marketed to children are not required to test the products before selling them to children.  Furthermore, the federal agency responsible for product safety, the U.S. Consumer Product Safety Commission (CPSC), can only initiate a recall of a product under extreme circumstances.  Most recalls are “voluntary recalls” initiated by the companies responsible for the defective product’s manufacture, importation, distribution, and/or sale in the United States. 

Many of the products involved in child safety recalls come from China and other countries where standards in manufacturing plants are not high.  Mattel has recalled millions of toys made in China that have high-lead-content paint on them.  Candy made in Mexico has been recalled due to lead content.  These are two examples of numerous child-safety recalls that are initiated each year.  At Pritzker | Ruohonen we care about child safety and have contacted U.S. Senators regarding some of these recalls and the need for more power for the CPSC to actually do what its name suggests—ensure that products sold to consumers are safe.

Child-Safety Recalls Information

As a public service, Pritzker | Ruohonen provides information about child-safety recalls.  This is not an exhaustive list of all child-safety recalls, but does include recalls of products that could cause serious injury or death. 


Bayside Furnishings Bed Recall
Bayside Furnishings has recalled about 9,350 LaJolla Boat Bed and Pirates of the Caribbean Twin Trundle Beds. The lid supports on the toy chests fail to prevent the lid from closing too quickly, posing an entrapment and strangulation hazard to young children. At least one child has died.

Stanley Crib Recall
Stanley Furniture Company has recalled about 1,200 2nd Nature Built to Grow Cribs. The cribs could fail to meet a federal safety standard for crib dimensions. When the mattress support is in the middle setting, the space between the mattress and the crib could be too wide, posing an entrapment hazard to infants.

KYMCO Mongoose ATV Recall
KYMCO USA has recalled about 1,700 2008 Model Year Mongoose Youth ATVs. A manufacturing defect in the carburetor can cause the throttle to stick open, posing a risk of serious injury or death to the rider.

Arctic Cat ATV Recall
Arctic Cat has recalled about 6,000 youth model Arctic Cat ATVs: Model Year 2008 Arctic Cat 50cc and 90cc All-Terrain Vehicles (ATVs).

Jardine Crib Recall
Jardine Enterprises has recalled about 320,000 Jardine cribs. The wooden crib slats and spindles can break, creating a gap, which can pose an entrapment and strangulation hazard to infants.

Wal-Mart Charm Key Chain Recall
Wal-Mart has recalled certain key chains because the charms contain an excessive amount of lead. The Illinois Attorney General informed Wal-Mart and CPSC on April 16, 2008, that the key chain was found in the home of a 9-month-old child who was discovered to have high blood-levels of lead. The child was observed mouthing this key chain.

Stove Tip Overs
 There have been hundreds of injuries and at least 33 deaths associated with stove tip-overs. Children are at risk for severe burn injuries, traumatic brain injuries, and death. There has not been a recall in association with this hazard, but there should be.

Simplicity Crib Recall
September 21, 2007 - The U.S. Consumer Product Safety Commission (CPSC) is announcing today a voluntary recall with Simplicity Inc., of Reading, Pa., of about 1 million cribs. The drop-side can detach from the crib, which can create a dangerous gap and lead to the entrapment and suffocation of infants. CPSC is aware of two deaths in Simplicity manufactured cribs with older style hardware, including a 9-month-old child and a 6-month-old child, where the drop-side was installed upside down.CPSC is also aware of seven infant entrapments and 55 incidents in these cribs.

Equate and Member's Mark Wet Wipes Sold at Wal-Mart and Sam's Club
November 17, 2006 -- Rockline Industries announced that it has initiated a voluntary nationwide product withdrawal to the retail level of certain lots of its store brand wet wipes—Equate and Member’s Mark wet wipes sold at Wal-Mart and Sam’s Club.  The voluntary withdrawal is a result of routine product testing that detected the presence of a micro-organism known as Burkholderia cepacia (B. cepacia).

Recall of Toy Vehicles and Toy Pliers Due to Choking Hazard
The CPSC recalled about 3,500 units of Primary Sounds Toy Vehicles. Prior to the recall, Kids Preferred LLC, the importer/distributor of the toy, received one report of a wheel and hubcap detaching from the toy while a child was playing with it.

Recall of Infant Musical Toy Chair
The recalled Laugh & Learn Musical Learning Chair is a plastic infant toy that measures about 17 inches high. It plays music and teaches children numbers and letters. It also features a blue chair with four green plastic legs and a side table with a purple base and white top.

Target Baby Rattle
Small parts on the plush rattles and frame ornaments can break or detach, posing a choking hazard to young children. Additionally, the rattles’ plastic ring can break and expose sharp points.

Rainbow Play Systems Swing Seat Recall: Lawyer and Information
May 18, 2006 – The U.S. Consumer Product Safety Commission (CPSC) and Rainbow Play Systems Inc., of Brookings, South Dakota, announced a voluntary recall of about 18,400 sling swing set seats that sold as an accessory with Carnival, Sunshine, and Rainbow Series residential play structures manufactured by Rainbow Play Systems, Inc.

SlingRider Infant Carrier
The plastic slider on the fabric strap can break. This can cause the strap supporting the carrier to release and infants to fall out of the carrier.

Shirley Temple DVD Metal Charm Recall Due to Lead Poisoning Risk
The recalled silver-colored metal charms were included as a free giveaway in certain Shirley Temple movie DVDs in specially marked pink boxes. Some DVD boxes contain only charms. Others contain charm bracelets with charms. The charms come in various shapes including animals, hats, treble clefs, and lollipops. The DVD boxes are marked with “Bonus Charm Bracelet Inside,” or “Bonus Charm Inside.”

Polly Pocket Magnetic Play Set Recall
November 21, 2006 – The U.S. Consumer Product Safety Commission, in cooperation with Mattel Inc., today announced a voluntary recall of Polly Pocket magnetic play sets. Consumers should stop using the recalled Polly Pocket toys immediately.

Playskool Toy Tool Bench Recalled after Two Children Die
Two children died while playing with a Playskool Team Talkin’ Tool Bench toy.  As a result of these deaths, on September 22, 2006, the Consumer Product Safety Commission announced the recall of  about 255,000 Team Talkin’ Tool Bench toys manufactured by Playskool, of Pawtucket, R.I.

Dollar Store KI Pacifier Recall
May 25, 2006 – The U.S. Consumer Product Safety Commission (CPSC) and Kole Imports of Carson, California (KI) announced the recall of about 3,600 packages of “Baby 2 Pack” pacifiers.  The pacifier’s nipple can easily detach from the guard, posing a serious choking hazard to young children.

Mag Stix Recall
Small magnets inside the plastic sticks can fall out. Magnets found by young children can be swallowed or aspirated. If more than one magnet is swallowed, the magnets can attract each other and cause intestinal perforation or blockage, which can be fatal.

Magnetix Lawsuit: Urgent Warning about Magnetix
April 19, 2007 - Additional serious injuries to children reported following the March 31, 2006 recall announcement of Magnetix Magnetic Building Sets have prompted the U.S. Consumer Product Safety Commission and Mega Brands America, Inc. (“Mega Brands”) (the new owner of Rose Art Industries, Inc.) to announce an expanded recall. In excess of 4 million units are involved.

Magnetix Magnets - Death Results in Recall
The CPSC is aware of 34 incidents involving small magnets, including one death and four serious injuries. A 20-month-old boy died after he swallowed magnets that twisted his small intestine and created a blockage. Three children ages ranging from 3 to 8 had intestinal perforations that required surgery and hospitalization in intensive care. A 5-year-old child aspirated two magnets that were surgically removed from his lung.

MagneBlocks Magnetic Toys
Tiny magnets inside the MagneBlocks™ building pieces can fall out. Magnets found by young children can be swallowed or aspirated. If more than one magnet is swallowed, the magnets can attract each other and cause intestinal perforation or blockage, which can be fatal.

FDA and Mead Johnson Recall of GENTLEASE Infant Formula
A February 2006 U.S. Food and Drug Administration (FDA) news alert announced the recall of over 40,000 cans of GENTLEASE powdered infant formula manufactured by Mead Johnson. The recalled GENTLEASE powdered infant formula affected is lot number BMJ19, use by 1 Jul 07. This lot was found to contain metal particles, consisting of up to 2.7 millimeter in size, large enough to present a serious risk to an infant's respiratory system and throat.

$975,000 Fine for Fisher-Price
March 1, 2007 – The U.S. Consumer Product Safety Commission (CPSC) announced today that Fisher-Price Inc., of East Aurora, N.Y., has agreed to pay a $975,000 civil penalty. The penalty, which the Commission has provisionally accepted, settles allegations that the company failed to report to the government that a nail fastener in the Little People® Animal Sounds Farm could separate from the toy and pose a serious choking or aspiration hazard to young children.

Reebok Bracelets Recalled after Minnesota Child Dies from Lead Poisoning
March 23, 2006—The U.S. Consumer Product Safety Commission (CPSC) has recalled about 300,000 Reebok Heart-Shaped Charm Bracelets due to high levels of lead, which poses a risk of lead poisoning and adverse health effects to young children.

Lawyer Warns of Baby Walker Recalls due to Stairway Fall Hazard
According to the CPSC recall announcements, two of the companies, SunTome Trading Corp. and Bike Pro, Inc., originally recalled these baby walkers on July 20, 2001, and October 9, 2002, respectively. They sold the defective walkers through January 2006. All together there are about 51,600 defective baby walkers sold. According to the CPSC, consumers should stop using recalled products immediately unless otherwise instructed.

Baby Teether Recall
According to the company, “The liquid inside the teethers may contain pseudomonas aeruginosa and pseudomonas putida which can cause serious illness in children if the teether is punctured and the liquid from the teether is ingested.” 

Urgent Warning: Aspen 3 in 1 Crib with Graco Logo Recalled
February 8, 2006–After the death of a 19-month baby in Myrtle Creek, Ore., the U.S. Consumer Product Safety Commission (CPSC) and Simplicity Inc., of Reading Pa., have renewed the search for about 104,000 recalled Aspen 3 in 1 Cribs with Graco logos. The child died on January 6, 2006, after two of the mattress support slats came out of his recalled crib. He became entrapped between the mattress and the footboard of the crib and suffocated. Several other children have been injured, but this is the first reported death.
