Subway Salmonella Lawsuit Investigated

Pritzker Olsen law firm is preparing to file a lawsuit on behalf of a 52-year-old resident of Tazewell County, Illinois who became ill after eating an oven-roasted chicken sub on May 11 at the Subway on 603 Jackson Street in Morton, Illinois. She was hospitalized with salmonellosis (an infection caused, in this case, by Salmonella Hvittingfoss) for several days after suffering gastroenteritis with cramping and severe vomiting.

Because our law firm has years of experience in this area, we know how to investigate and litigate these cases. Contact us about investigating your Subway Salmonella case.

Subway Salmonella Lawsuit: The Evidence

As of June 21, 2010, there are 97 cases of salmonellosis caused by the same strain of Salmonella Hvittingfoss in Illinois. Epidemiological evidence has found that the connecting factor is consumption of food prepared at one of over 40 Subway restaurants in Illinois. This strong associatioin with eating at Subway and illness is enough evidence to file a claim for money damages against Subway.

One of the questions we often hear is, "What if the food that caused the outbreak can't be found?" In many food poisoning outbreaks the food that made people sick is eaten or thrown out before there can be an investigation. For example, we recently won a case involving several people sickened at a restaurant. After months of investigation, the food that make the people sick could not be pinpointed. Our argument went something like this:

  • Several people contracted the same strain of Salmonella illness after eating at the restaurant.
  • Eating at the restaurant was the only logical connecting factor between these people.
  • Some food item served at the restaurant must have made these people sick.
  • The restaurant is liable for any illnesses caused by food it prepared.

Part of doing business as a restaurant is being responsible for any harm caused by its food. Restaurants have insurance to cover this, and both the restaurant and its insurance company should take this responsibility seriously.

Compensation for Salmonella victims and their families can include money for the following:

  • Hospital bills and other medical expenses
  • Lost income
  • Pain and suffering
  • Emotional distress
  • Disability
  • Loss of quality of life
  • Other damages

Because the complications of Salmonella can be severe, victims should seek money for future (expected) medical expenses, lost income, pain and suffering and other damages.
