Woman Killed in Minneapolis while in Crosswalk

Yesterday, a woman walking in a crosswalk in downtown Minneapolis was hit and killed by a pickup truck. She had left work early because of the weather, according to news reports.

The preliminary investigation found that on Tuesday, February 2, 2016, the pedestrian was walking in the crosswalk at the intersection of Hennepin Avenue and 8th Street at about 4:45 p.m. At the same time, the pickup truck driver attempted to stop, but could not, allegedly due to snowy roads.

This tragic death is a reminder that drivers need to slow down when the weather is bad. Legally, drivers have to drive slower than the speed limit if necessary because of road conditions. This means a family can sue a driver for wrongful death if the driver was going the speed limit but it was still too fast because of icy roads.

Below are two of the many questions that need answers to determine if there is a wrongful death claim:

  • Was the truck driver driving too fast for the road conditions and weather?
  • Was the driver distracted at the time of the crash?
