Can I Sue Roos Foods and Megamart for Listeriosis Food Poisoning?

You can sue Roos Foods if the following is true:

  1. You were diagnosed with listeriosis food poisoning or your family member (parent, spouse, child, grandchild, etc.) died from the illness; and
  2. You have evidence that cheese made by Roos Foods caused your or your family member’s illness (read about the Roos Foods cheese recall and outbreak).

You can sue Megamart if the above is true and you have evidence that Roos Foods cheese repackaged by Megamart caused the case of listeriosis. Special laws apply to grocery stores and other retailers in most states. Our listeriosis lawyers can help you with this. Attorney Fred Pritzker is our lead lawyers for these cases.

Fred  recently won a million dollars in a lawsuit against another cheese producer and another retailer. The facts of that case were almost identical to the facts surrounding this listeriosis outbreak.  Fred’s client purchased cheese that a retailer had purchased from the processor. The retailer had then repackaged and rebranded the cheese, which is considered further processing of the cheese. This was important because some state laws protect retailers from food poisoning lawsuits unless the retailer has repackaged the product or provided samples of the product.

Roos Foods has issued three recalls of cheese in the last several days.  Our investigation into the outbreak that has resulted in severe illnesses and one death will look at sanitation protocol at the Roos Foods plant, whether it was followed, when Roos Foods was aware that there was a risk of its cheese being contaminated with Listeria monocytogenes, the bacteria that causes listeriosis, why all of the potentially contaminated cheese was not all recalled at once, and other issues.

Personal Injury and/or Wrongful Death Claim

These cases are always tragic. Listeriosis often causes brain damage and other severe injuries, and it is often fatal.  For this reason, it is important to hold corporate wrongdoers accountable.

Your lawsuit will involve either a personal injury or wrongful death claim. You will sue for personal injury compensation if you are a listeriosis survivor. You will sue for wrongful death if a family member died from this illness. If you are a mother who lost a newborn baby, you will have both personal injury and wrongful death claims.
