Fred recently won a million dollars in a lawsuit against another cheese producer and another retailer. The facts of that case were almost identical to the facts surrounding this listeriosis outbreak. Fred’s client purchased cheese that a retailer had purchased from the processor. The retailer had then repackaged and rebranded the cheese, which is considered further processing of the cheese.
