Statute of Limitations for Children in Minnesota

Lead Poisning ChildParents can sue on behalf of their minor children. Our law firm has represented many families in this situation. This is often in the best interest of the child and the parents, who may also have claims for lost income and other damages.

Injured children and their parents need to be aware of the Minnesota statute of limitations (the statutory time a person has to file a suit) under Minnesota Law. Under Minn. Statutes, Section 514.15(a)(1), a child has until the age of 19 to initiate litigation, even if the statute of limitations would normally have run before the age of 19.

Personal Injury of Child in Minnesota: Practice Areas

  • Child Injured in an Auto Accident - The primary issues are medical expenses and pain and suffering, which can include emotional distress, disability, disfigurement and loss of quality of life. Our attorneys are some of the few in the state that have the experience and resources to handle accidents with semi trucks (18 wheelers) involving a car, minivan, van, SUV, bus, snowmobile or child walking on the side of the road or crossing the street.
  • Defective Children's Products - Our Minnesota attorneys have won money for children injured by toys, furniture, food, vehicles and other defective products. Our efforts have resulted in product recalls and millions of dollars for our clients.
  • E. coli and HUS in Children - Our lawyers are some of the very few in the U.S. with experience in the area of E. coli lawsuits. We represent children with hemolytic uremic syndrome (HUS), a potentially fatal illness that can lead to kidney failure, paralysis, blindness, brain damage and heart failure.
  • Lead Poisoning - Many people do not realize that lead poisoning in old buildings is still a major problem. Unfortunately, children in lower income families are at greater risk of getting lead poisoning from their residence, usually an apartment.
  • Birth Injuries - Birth injuries can happen even after the head of a baby is safely out of the birthing canal. One bad decision by a doctor, midwife or other medical professional can lead to a lifetime of physical and/or mental problems.
  • Playground Injury - Serious playground injuries generally involve traumatic brain injury (TBI) and/or spinal cord injury (SCI).
