Ortho Evra Birth Control Patch—Blood Clots

The Ortho Evra birth control patch has been linked to an increased risk of blood clots that can lead to pulmonary embolism, stroke and heart attack.  In November 2005 the Food and Drug Administration (FDA) approved updated labeling for the Ortho Evra birth control patch to warn healthcare providers and patients that this product exposes women to higher levels of estrogen than most birth control pills. Research has shown that increased estrogen exposure may increase the risk of blood clots, which in turn lead to a host of serious health problems, including pulmonary embolism, stroke and heart attack.

The new warning on the label specifically states that women who use Ortho Evra are exposed to about 60 percent more total estrogen in their blood than if they were taking a typical birth control pill containing 35 micrograms of estrogen. This happens because, with the Ortho Nova birth control patch, the estrogen levels in the blood are maintained at a consistent level.  Although birth control pills deliver a higher level of estrogen when taken, that level rapidly declines throughout the day.  It is the consistently higher levels of estrogen flowing through the blood vessels that leads to the clotting.

There have been a number of lawsuits filed against Johnson & Johnson due to injury from the Ortho Evra birth control patch.  For lawsuits involving serious injury Johnson & Johnson has been quick to settle:

At a May 2 status conference with U.S. District Judge David Katz in Cleveland, where 73 cases from around the country have been consolidated, a Johnson & Johnson lawyer announced that the company is prepared to settle all suits in which plaintiffs were hospitalized for stroke, heart attacks, pulmonary embolisms or deep vein thrombosis.

The same day, Johnson & Johnson lawyer Susan Sharko wrote to Superior Court Judge Peter Bariso in Hudson County that the company had reached confidential settlements with 11 of the 12 plaintiffs who sued there. (New Jersey Law Journal)
