Degree of Fault

When possible, each negligent party responsible for an injury is found liable for a certain percentage of the damages from the injury.  This is the negligent party’s “degree of faulty.”  For example, if three people are found liable for a car crash injury and the degrees of fault are 10% , 40% and 50%, $500,000 in damages would be apportioned as follows:

    1. $50,000
    2. $200,000
    3. $250,000

Single Indivisible Injury Rule
If it is not possible, given the nature of the accidents, to prove degree of fault, each negligent driver may be held liable for all of the damages resulting from the injury under Minnesota’s “single indivisible injury” rule.  The single indivisible injury rule provides that if there is not enough evidence to determine degree of fault, the negligent parties are jointly liable for all damages for an injury, meaning each party is liable for the total amount of damages.

Joint and Several Liability
If degree of fault was proved, the possibility exists that one of the parties cannot or will not pay their portion of damages.  If this happens, any one of the other negligent parties may have to pay that share under the principle of joint and several liability.  In Minnesota there are statutory restrictions on joint and several liability.
