Listeriosis Food Poisoning and Stillbirth

BacteriaListeriosis is a type of food poisoning caused by Listeriosis monocytogenes, bacteria that can contaminate food during or after processing. Pregnant women are at the greatest risk of contracting listeriosis, and when they do, the Listeria bacteria can infect the unborn baby through the placenta.

Listeriosis stillbirth cases usually involve sepsis and/or meningitis:

  • Listeriosis and Sepsis. Sepsis (septicemia) is sometimes referred to as blood poisoning.  It is a potentially-fatal condition in which your immune system's reaction to an infection in the blood can lead to multiple-organ failure.  Listeria sepsis happens when Listeria (L. monocytogenes) bacteria infects the blood and causes an infection of the blood.
  • Listeriosis and Meningitis. Meningitis is an infection of the meninges, the membranes that surround the brain and spinal cord, and the related fluids. Listeria meningitis presents itself differently than other types of bacterial meningitis.  Listeria can directly invade the cerebral cortex, posing additional complications, including hydrocephalus (a condition in which cerebrospinal fluid is accumulated in the brain) and cervical cord compression.

Listeriosis Stillbirth Lawsuit

If your baby's stillbirth was due to listeriosis, you may have a claim for money damages against a food manufacturer, restaurant, or other party. Common food sources of Listeria are deli meats, hot dogs, kid’s refrigerated meals, smoked salmon and soft cheese. But Listeria has been found in frozen waffles, alfalfa sprouts, potato products, and a variety of other food products.

For a listeriosis victim to get money damages, a food manufacturer, distributor, restautant or other party has to be found liable. For this to happen, your lawyer will have to prove that a specific food item caused the listeriosis. This is called "causation," and it can be difficult to prove.

  • Cost of care
  • Lost income
