Milan McDonald's Hepatitis A Outbreak Could Have Been Prevented

The McDonald’s in Milan, Illinois has been associated with a hepatitis A outbreak that has sickened at least 30 people who reside in Henry, Mercer and Rock Island counties.

VaccineHealth officials suspect that the outbreak was caused by a sick employee.  A simple $50 shot could have prevented the outbreak. We have long advocated that every employee at every restaurant be given the hepatitis A vaccine to prevent situations like the one we recently handled in Arizona where several people were hospitalized.

“We represent hepatitis A victims throughout the United States, and every time we have advocated for widespread administration of the hepatitis A vaccine in the food service industry,” stated attorney Fred Pritzker.  “Sadly, restaurants like McDonald’s would rather have customers get seriously ill than spend the money on the vaccine.”

McDonald's Hepatitis A Lawsuit: Restaurant Liability

McDonald's Hepatitis A LawsuitThe hepatitis A virus is spread from person to person by “fecal-oral” transmission. This means the virus is transmitted when a person puts something in his/her mouth that has been contaminated with the stool of a person infected with the hepatitis A virus.

In this case, the most likely scenario is that a McDonald's employee infected with hepatitis A did not wash their hands well after having a bowel movement and got some fecal matter on food. This food with the employees fecal matter on it was then served to customers, at least 30 of whom became ill.

Restaurants are strictly liable for all illnesses caused by their food. This means that they are responsible to compensate victims for their losses.
