Cantaloupe Wrongful Death Lawsuits

Our attorneys have been retained by the families of people who died from complications of listeriosis, an illness caused by Listeria monocytogenes, a foodborne pathogen. The firm is investigating whether these deaths are part of the Listeria outbreak linked to Rocky Ford cantaloupe grown by Jensen Farms on its fields in Granada, Colorado.

One of the cases involves the death of a 76-year-old DuPage County, Illinois man. He had eaten cantaloupe every day before he had symptoms of listeriosis. He was diagnosed with listeriosis, hospitalized, and released a few days later. His condition worsened, and he was hospitalized a second time. He died on September 11, 2011. As with all of the wrongful death cases, this one involved severe pain before the man's death.

The listeriosis outbreak linked to Jensen Farms cantaloupe has sickened at least 139 people in 28 states and continues to grow. To date, the CDC has confirmed the following illnesses and deaths: Alabama (1), Arkansas (1), California (2), Colorado (39), Idaho (2), Illinois (3), Indiana (3), Iowa (1), Kansas (10), Louisiana (2), Maryland (1), Missouri (6), Montana (1), Nebraska (6), Nevada (1), New Mexico (15), New York (2), North Dakota (2), Oklahoma (11), Oregon (1), Pennsylvania (1), South Dakota (1), Texas (18), Utah (1), Virginia (1), West Virginia (1), Wisconsin (2), and Wyoming (4).

Thirty deaths have been confirmed: Colorado (8), Indiana (1), Kansas (3), Louisiana (2), Maryland (1), Missouri (2), Nebraska (1), New Mexico (6), New York (2), Oklahoma (1), Texas (2), and Wyoming (1). One of the deaths was of an unborn baby that was miscarried when the mother's listeriosis infection sickened the child. Listeriosis illnesses in several other states are currently being investigated by state and local health departments to determine if they are part of this outbreak.

Jensen Farms Cantaloupe RecallJensen Farms has recalled whole Rocky Ford cantaloupe. Prior to the recall, retailers sold this potentially-contaminated cantaloupe to consumers, including many who became seriously ill. Several have people died. Retailers who received recalled cantaloupe include Walmart, Albertsons, Whole Foods Market, Supervalue (retail network includes ACME®, ALBERTSONS®, CUB®, FARM FRESH®, HORNBACHER'S®, JEWEL-OSCO®, SHAW'S/STAR MARKET®, SHOP ‘N SAVE® and SHOPPERS®), King Soopers.

Listeria contamination is caused by poor sanitation. The situation gets worse when growers and others do not adequately test for Listeria contamination. Those responsible for this outbreak need to be held accountable for the medical expenses, pain and suffering and other damages suffered by victims and their families.

  • New Mexico Listeria: At least 10 people were sickened. Four of them died. The New Mexico Environmental Health Bureau has identified two macro-distributors of Jensen Farms cantaloupe in New Mexico: Basila Produce in Albuquerque & Wal-Mart Distribution in Los Lunas. State inspectors have found the cantaloupe named in this recall in several Wal-Mart and Whole Foods stores. Three of New Mexico’s fatal cases include: a 93-year-old man from Bernalillo County, a 61-year-old female from Curry County, and a 63-year-old man from Bernalillo County. All other New Mexico cases have been or are currently hospitalized and come from Bernalillo, Chaves, Otero, De Baca, Valencia and Lea counties. The ill people range in age from the 43 to 96 and include 4 men and 6 women. Illness onset ranges from August 20th to early September.
  • Colorado Listeria Outbreak: There are 15 confirmed cases of listeriosis caused by cantaloupe. Two people have died, including a 48-year-old woman. All of the people sickened were hospitalized. People in the following Colorado counties were sickened: Adams, Arapahoe, Boulder, Denver, Douglas, El Paso, Jefferson, Larimer and Weld. The age range is from the 30s to the 90s. The average age is 84. The majority are female.
  • Oklahoma Listeria: There are eight cases of listeriosis related to cantaloupe shipped by Jensen Farms from the Rocky Ford, CO, growing region. All were hospitalized and one of these died.  An additional two listeriosis cases are under investigation, and are suspected to be related to the nationwide outbreak.  All of the Oklahoma cases are over the age of sixty.  While particularly severe for the elderly, pregnant women and those with weakened immune systems, state officials recommend that all Oklahomans avoid recalled Rocky Ford cantaloupe shipped by Jensen Farms.
  • Texas Listeria: 14 people from Texas have become ill after consuming Rocky Ford cantaloupe. All were hospitalized, and 2 died.
  • Nebraska Listeria: Four people have been sickened, including two people in Douglas County.
  • Missouri Listeria: Two people were sickened. One of them died.
  • Illinois Listeria: One confirmed case and one probably wrongful death case connected to the cantaloupe outbreak.
  • Wyoming Listeria:One case of listeriosis in a Laramie County man is linked to the multistate outbreak connected to Colorado-grown cantaloupe.
  • West Virginia Listeria: One person was sickened.
  • Indiana Listeria: One person was sickened.
  • Maryland: One person died.
  • California: One person was sickened, and one death is likely caused by the outbreak.
